The suspect, David Drummond, who is charged with the murder of his mother Shirley Awer, may be released back into the community due to an evidence glitch. Despite being in custody, Drummond could be cleared after a mental health evaluation and be out on the streets of New York once again.

According to a source, the assistant district attorney mentioned that they did not have enough evidence to indict Drummond. An employee, speaking anonymously, expressed concern over releasing someone with Drummond’s long history of mental health issues back into the community.

Drummond, diagnosed with schizophrenia, was involved in the murder case of his mother, whose body was found stuffed in a box in their shared apartment. As the cause of the mother’s death is unclear and the autopsy is yet to be completed due to the state of the remains, prosecutors have been unable to proceed with the case.

While Drummond is currently undergoing a mental health evaluation at Bellevue Hospital, there are concerns about holding him there indefinitely if he is not deemed a threat. The employee stressed the high standard for involuntary commitment and criticized the justice system for potentially releasing someone who could pose a danger to society back into the civilian unit at the hospital.

Drummond’s next court appearance is scheduled for February 22.
